Lee County Circuit Court Judge R. Thomas Corbin listened to death row inmate Cary Michael Lambrix's attorneys, an assistant state attorney and an assistant attorney general to decide whether an alleged affair is grounds to determine a conspiracy.
Roseanne Eckert and William Hennis III argued in Lambrix's appeals process Tuesday that it would have been crucial for the jury and defense attorneys to know whether Frances Ottinger, Lambrix's girlfriend at the time he killed two people, had had an intimate relationship with Robert Daniels, a former state attorney's office investigator.
During an April 2004 hearing, Ottinger testified she had an affair with Daniels. In July, Daniels denied the allegation.
Lambrix, 46, was sentenced to death in 1984 for the murders of Alisha Bryant, 19, of LaBelle and Lawrence Lamberson, 35, of Key Largo. Lambrix and Ottinger, then Frances Smith, met the two at a bar on Feb. 5, 1983. Prosecutors said Lambrix lured the two to his trailer and then took them outside and killed them. Lambrix said in the April 2004 hearing that he killed Lamberson in self-defense when he found Lamberson attacking Bryant.
Corbin said he would decide the matter as soon as he can.
